Ben is suing Fairfax for the mother of all defamation payouts.
He's also instructed his lawyers to brief the Australian Federal Police on the prima facie breaches of the criminal law disclosed by Fairfax's behaviour.
Here's part of his statement:
“The current position is unfair not only to me but all members of the ADF whose service to our country is being attacked by individuals who choose to hide behind anonymous leaking to the media of operational matters in breach of the Defence Act.”
“These people know I cannot respond in detail to their assertions without compromising national security and myself breaching the Defence Act. I would never do that.
“My lawyers have brought this matter to the attention of the Attorney-General and requested that as the first law officer he refer the matter to the Australian Federal Police for an investigation.”
“I look forward to in due course responding to the baseless allegations made against me.
When I do so, I will respond in a manner which is consistent with my obligations to uphold the laws of the Commonwealth.”
The Australian spoke to Tony Abbott:
“I would be very reluctant to judge soldiers operating in the heat of combat under the fog of war by the same standards that we would judge civilians operating in the ordinary circumstances of Australian life. The important thing here is if mistakes have been made is to take a remedial approach rather than a punitive approach.’’
Turnbull is a dog.
