The AWU Scandal - the AWU Perth Auditors
Monday, 29 October 2012
Mark Baker has today followed up on Detective Sergeant McAlpine's work in interviewing the AWU's auditors.
You've read Mark's story here
Here's Sergeant McAlpine's entry on his running sheet.
FGS Michael get everything up befor Parliament ends!

Interesting "todo" from Sgt McAlpine;
"2) Seize w/processor to see if invoices etc are still on the "
Hands up anyone who really believes that happened.
Maybe they'll find it in the same place that the S&G and WA Corporate Affairs files are.
Another bottom of the harbour job I reckon.

Yes, dragging this out is pointless.

I wonder if the WA investigating officers ever looked at the incorporation files of the AWU-WRA that are now missing.
How would one go about finding out?

In a prevous post you wrote:
"You will have heard of the Boulder conference where local miners were convinced their funeral and death money would be better off if it was taken out of their hands. You may also have heard of the holiday flats at Kalbarri that were apparently bought with that money. You might have heard of the Ford dealer who apparently sold the flats and his generosity with motor cars."
Can you give a clue where to look for more on this please.

Here's the obvious point- Just the mere fact that Gillard had to explain to her S and G partners what the AWU-WRA was (ie a vehicle for collecting Union "slush" funds) proves that this was NOT common Union practice at the time...
Such re-election funds were maintained within the Unions accounting system as separate accounts that Union officials had deductions from their pay regularly deposited into, as the WA Branch accountant at the time points out... Such an account had already been set up by Wilson...
So if Julia Gillard pulled the strings to get THIS completely unaffiliated (the key point here)body set up (she does not deny that she KNEW it was being set up as an unaffiliated body... Indeed, she intended it to be separate to other official Union bodies for similar purposes), then what possible reason could she have for taking such action AND THEN failing to notify either her partners at S and G or indeed their clients (and hers) the Union of its existence or her role in its existence??
She set it up therefore knowing that the due officers of the Unions' financial control and management had no knowlege of it. She saw no need to advise them of same, or her partners at S and G...
Further she knew financial activities and accounts were being operated from within it, as her Blewitt Power of Attorney and conveyancing on the Fitzroy property readily reveals...
So the two things together... She knows the Unions' financial control personnel have no knowledge of AWU-WRA's existence, as it exists OUTSIDE their systems (ostensibly on her advice and with her explicit assistance to establish)... She also knows beyond doubt that large sums of money are being funneled through it by Wilson, whom she directly helps to get money into it (recall her visit to the speak with Wilson to the WA workers resulting in AWU-WRA taking control of their $) and also to be solely in control of the flows of these funds (POA from Blewitt)
At best, Gillard is evidentially knowingly complicit in these affairs... At worst she is the real mastermind behind the construction, operation and hiding of this complex fraud..
We should be demanding that the police do their job and speak to Blewitt... We also should be demanding a royal commission as soon as the Coalition is elected...

Gillard Explains How Labor Plans For The Future
The Plan
In the beginning was the Plan.
And then came the Assumptions.
And the Assumptions were without form.
And the Plan was without substance.
And the darkness was upon the face of the Workers.
And they spoke amongst themselves, saying, “It is a crock of shit and it stinketh.”
And the workers went unto their Supervisors and said, “It is a pail of dung and none may abide the odor thereof.”
And the Supervisors went unto their Managers, saying, “It is a container of excrement and it is very strong, such that none may abide it”.
And the Managers went unto their Directors, and reported, “It is a vessel of fertilizer and none may abide its strength.”
And the Directors spoke amongst themselves, saying one to another, “It contains that which aids plant growth and it is very strong.”
And the Directors went unto the Vice Presidents saying, “It promotes growth and it is very powerful.”
And the Vice Presidents went unto the President saying, “This new Plan will actively promote the growth and vigor of the company with powerful effects.”
And the President looked upon the Plan and saw that it was good. And the Plan became policy.
And this is how ALP Shit Happens!

Michael,
I applaud your efforts and courage in pursuing this corruption.
And yet still much of the mainstream media ignores it. Much of it is too esoteric for the average apathetic punter in Australia to even consider in the court of public opinion. And it seems that the appropriate authorities are reluctant or hobbled in pursuing it.
At what point does/can one pull all this into a brief of evidence for a civil prosecution ( e.g. under the Crimes Act 1914)? I believe there is clear past precedent for civil proceedings being initiated and subsequently taken over as criminal prosecutions. Maybe this is the way to get the ball rolling after the crooks.
Surely there must be some decent lawyers out there who could help.

Hi Michael,The PM was just asked by Julie Bishop (2.45pm) re the AWU. As usual she didn't answer the question. Have a look. Regards ConC

Have a look at "Kangaroo Court" (Link below) - looks like a carbon copy of Gillards AWU scam.
What did Bill Shorten say? HSU is an isolated incident, or words to that effect. He's complicit, the whole of the ALP are thieving crooks, they steal taxpayers money to fund their party then continue to steal our money and squander it whilst in power.
How can we be rid of this pestilence?

Re Bring back the balance @ 12.54pm:
Agree with all of that, and one other thing to add:
My understanding is that it is common practice for companies (those with some sense of proper procedure) who wish to "donate" money to a union for the "benefit" of its members to instruct the company solicitor to transfer funds to the trust fund of the union's solicitor. In that way union auditors/accountants could account for these funds. Of course, in view of the parlous state of some unions today, this is clearly not universal.
The practice of "donation" of any funds is obviously a threat to union integrity. Whether any Royal Commission can entirely eliminate it through its recommendations , is another question.

Michael, after yesterday's newspoll result there is a palpable feeling of depression and frustration. Please could you give the troops a bit of a pep talk? To the best of your knowledge is there any progress happening behind the scenes that we are not yet fully aware of? The Victorian police investigation into your report? any new witnesses? I'm feeling really despondent and demoralised ATM, goodness knows how you must be feeling. Please give us something to hang our collective hats on.

Very well put. So. how do we induce the police to act, if they will not?
Order for mandamus from the Supreme Court?
http://www.lawhandbook.org.au/handbook/ch21s02s03.php#
Mandamus is an order issued by the court against a tribunal, public body or official requiring it to perform a duty which it has failed to perform.
Private information and summons?

@Robbo 3:12Pm
Robbo I Was on Kangaroo Court site last night reading the same article and was also flabbergasted at what I Was reading. Robbo you are right in that they always say oh that was an isolated incident it is there usual pathetic excuse they use for every thing when they get caught out. Time is ripe to bring these highway men to account.

The PM could not use public funds to pay for lawyers. It would be hard for her to run the country if she was putting out legal bushfires in the courts.
Is there enough information to get an order for mandamus? I suppose it depends on the genuineness of the POA, and the registration of the AWU-WRA and the handwriting on the back of the cheque, and the adequacy of the intial police investigation. That would have to be put before the court I suppose.
An interesting idea? Any lawyers outh there that might have thoughts?

I'm an ex bankie, from 1977-1990. I seem to recall that incorporated bodies who wished to open bank accounts had to supply a copy of the constitution of the organization and a copy of the relative minute for sighting by the Bank before accounts could be opened. Maybe Mr Blewitt could be asked about the actual opening of the accounts and if these documents were provided to the Bank.
I know it's a long shot, but could there be any documents in old records?

Everyone take heart,as the brickbats are still at hand and waiting for the election, just as they were in NSW, Qld, NT and even most of the ACT!
The Newspoll is another rogue.
Essential, usually more left than Newspoll still has the government lagging well behind and they t ake a larger sample than s does the Newspoll. Personally, I reckon they have sought out silly 18- 21yr old females for their poll this time!
Gillard will hang on as leader but she is GONE big time!
It would be nice to think she would be gone through Michael's efforts, though as that would be icing on our cake!
