His Honour Judge Rod Madgwick - starring in an ACTU ad campaign to get rid of the Building and Construction Commission

Justice Rod Madgwick was the presiding judge of the Industrial Relations Court of Australia in the AWU matters that included 2082/96 - the case with the missing files.

Justice Madgwick appeared in a television campaign, in a private capacity, as part of the ACTU's Your Rights on Site advertising campaign.

The unions that funded the campaign included the AWU and the aims of the campaign are still set out on the Your Rights on Site website.

Rights on Site is the campaign to get rid of the Australian Building and Construction Commission and make all Australian workers equal before the law.

And now The Federal Court of Australia's primary file on the matter, including boxes of material and computer records on multiple systems - all cleaned out.

Bob Kernohan was a respondent in matter 2082/1996 and he was served personally with documents in the early stages of the proceedings.

In this interview Bob describes how he was "asked" for the documents to be " returned" to the AWU, "my gut instinct said put these documents away somewhere safe".

 




Hedley was right! The Victoria Police have not executed their warrant to search the Federal Court regarding file 2082/96

The original documents filed in the Federal Court of Australia in matter 2082/96 will make for fascinating reading.

I understand that the law firms Slater and Gordon and Maurice Blackburn were served subpoenas along with the Commonwealth Bank and that each of those entities returned documents.

Hedley was correct in reporting this morning that Victoria Police intend to execute their warrant at a place where they'll be able to find the contents of that file.   Not much point if someone has been there before and cleaned the files out.

Rest assured that lines of enquiry are being pursued with various people who could help.

I think brothers and sisters of the AWU would join me in saying that your re-election - unopposed as it was - speaks volumes about the respect and appreciation you've earned in this room and around the country. There'd certainly be no argument here that the national conversation has benefited hugely from your growing contribution over the past few years. Together with Bill Ludwig - a giant of our movement - you've helped the AWU stand tall and unmoved as the first line of defence for so many hardworking Australians and their right to decent pay and fair conditions. And to Bill, mate frankly I reckon you could've knocked out another quarter of a century leading the mighty Queensland branch. But I do understand the need for fresh blood and I know you leave it in Ben's very capable hands. We're better every day for your stewardship of this great union – our union.

2082/96 - the missing boxes and boxes of files, exhibits, subpoenas and I'm told Orders

The letter from McClellands Solicitors (not Robert McClelland) to Stephen Harrison sets out the basis on which matter 2082/96 was brought before the court.   This letter details the actions at court up until 14 April, 1997.

You'll see that the action was brought by Bill Ludwig and it was against Wilson, Blewitt, Telikostoglou, Kernohan, the AWU-WRA Inc and others.

On 7 February, 2013, Victoria Police wrote to the Federal Court enquiring about the whereabouts and contents of file 2082/96.

Hedley's future tense might have been and gone - depends on that missing "file"

If things are as they appear to be - that is that matter number 2082/96 has disappeared in its entirety, there are grave implications for the administration of justice in Australia.

Detectives intend to execute search warrant to retrieve a legal file concerning Bruce Wilson

FEDERAL Court officials have been told by Victorian detectives investigating the AWU "slush fund" scandal that they intend to execute a search warrant at the court's registry to retrieve a legal file concerning Julia Gillard's allegedly corrupt former boyfriend, union official Bruce Wilson.

The file is regarded by police and legal figures, including former Australian Workers Union national secretary Ian Cambridge, now a commissioner for Fair Work Australia, as significant because it is believed to include several affidavits and evidence of allegedly corrupt payments by building companies to Mr Wilson.

A big thank you to Victoria Police from Rosie

What a lovely way to start the day!

 

Hello Michael,
Last night I went to see Geert Wilders speak in an outer Melbourne Suburb.
 
Perhaps I got there before or after anything happened – can’t say.
 
What I can say is that I was considering not going at some point – fear set in, but I felt I had to make a stand – for The West and our system of democracy.
 
Geert was amazing!
 
A privilege to be in his presence. So charismatic! So much truth.
 
But this could never have happened without the Victoria Police Force!! (Not to mention the Q Society).
 
I have never seen so many Police in one spot in my entire life!
 
All my fears dissolved when I saw them out the front of the venue: special thanks to the mounted policeSmile
 
They were fantastic!
 
Yes, there was a van of lefty/hippy/anarchists/ whatever but no one took any notice of them.Small numbers I think.
 
The ABC had a van also.
 
After the event some Muslim youngsters (in their 20’s) were passing out leaflets re Islam – quite polite, no problems there either.

Wasn't Jack Thompson great at the AWU conference?   

The new jobs package was great at the AWU conference too.   It got on the telly so it was a success too.

Now to find the $1 billion to pay for it.  Only joking!

Lenore Taylor has grabbed the well thumbed Gillard operational manual and this story pretty much wrote itself.   Announce a big plan, say it's paid for double check and find out it's not.   Oh well.

Rudd is Labor's last chance

This dysfunctional government should face the harsh reality. For the greater good, Gillard must go, Rudd should be reinstated and an election called immediately.

Good on Mark Baker and Fairfax for taking an independent line in describing Ms Gillard's activities in the lead up to the false incorporation of the sham entity the AWU-WRA Inc.

Mark says this,

One might have thought Gillard would be wiser to keep her distance from anything involving the initials AWU as the Victorian police fraud squad continues its intensive investigation into the hundreds of thousands of dollars stolen from an AWU slush fund she helped to incorporate as a young lawyer by her former boyfriend and AWU official Bruce Wilson, once the golden-haired protege of Bill Ludwig.

Gillard's illogical claim has been that she provided advice on the incorporation, like a benign observer,"I'd suggest a letter in a 10 point Times New Roman font, see you later."

Much of the media slavishly repeats the Gillard line, no doubt under lawyerly instructions.  To some extent I can understand why.   It's safe and she's a fierce and amoral offender in issuing threats and causing damage to people who say things she doesn't like.   But it's also misleading and we deserve the truth.

She wasn't giving advice from a distance.   She helped.  She acted in concert doing things to achieve the end of separating Thiess and the AWU from control of its money.  Blewitt's writing  is on the forms stating things that are false and misleading.   So is Gillard's.   There was no union authorisation to use the union's name.   If her claim is that Blewitt and Wilson gave her that authority she'd better hope for a deaf dumb and blind jury and a snoozing apres lunch judge.
