This is a synopsis of His Honour Justice Young of the Federal Court's findings about privilege.

First the synopsis on circumstances where client communications with a lawyer will not be subject to Legal Professional Privilege due to fraud - you can find Justice Young's original comments at paragraphs 210-219 of the judgement.
Hard to see how anyone could claim that communications with Ms Gillard or other partners at Slater and Gordon about the AWU-WRA were in any way the subject of legal professional privilege. Rather than an obligation to remain silent, I'd say there's a positive obligation on Slater and Gordon to report the frauds to authorities.
