With Craig Thomson and the Slater and Gordon search warrant matter in court today this seems like a great day for this update.
I would imagine that the timing of a Judicial Enquiry into The AWU Scandal will be determined by the conclusion of the Victoria Police and Legal Services Board of Victoria current investigations and prosecutions.
I thought this answer from Fair Work Australia about its inclination to investigate the AWU Workplace Reform Association and its use by Wilson et al was most insightful. This answer was given in the follow up to the Senate Estimates hearing of October, 2012 when Julia Gillard was the Prime Minister.
The original question was taken on notice. What a cop-out - the AWU is a registered organisation and the actions of several of its officials and outside advisers would be right within the scope of the Registered Organisations legislation. FWA has powers to investigate with powers to compel witnesses to give answers - would have been a very interesting few years if the old Industrial Registrar was still in place!
