Mr Rowe has been sworn, he has adopted his witness statement which has been tendered and received into evidence.
Senior Counsel Assisting is now reading elements of Mr Rowe's witness statement to the Commission and has asked Mr Rowe to recount his version of where and when he completed his Right of Entry Permit test.
Mr Stoljar has warned Mr Rowe that there are penalties for giving false evidence on oath, "Do you understand that?"
Mr Rowe says that he understands it.
Mr Rowe has been shown a Statutory Declaration he wrote out and swore. In it he states that he completed his Right of Entry Permit Test online all by himself. Mr Stoljar has again pointed out the serious penalties for swearing a flase Statutory Declaration. Mr Rowe persists with his story.
Mr Rowe has been shown a letter either from or to the HSU's solicitors Holding Redlich in answer to enquiries from the Fair Work Commission. The letter apparently contains statements that Mr Rowe completed his Right of Entry Permit test himself. Mr Stoljar asked Mr Rowe whether or not he told the truth to the union's lawyers - he states that he was truthful. He persists with the story. It doesn't seem to have very good legs.
The Commissioner has intervened to very specifically pin down Mr Rowe's version of events in relation to where and when he did his Right of Entry Permit test. Mr Rowe has given several versions in various statements and the like. He has now been pinned down in sworn oral evidence to the face of the Commission - he states that he did his own test by himself without assistance.
Mr Stoljar is now putting various documents to Mr Rowe and asking to give oral evidence about the truth of the statments/dates etc made in those documents.
Mr Stoljar has put all the necessary allegations to Mr Rowe who continues with his sworn evidence that he did his own Right of Entry Test.
At 9.39AM Mr Rowe was excused without examination by his own Counsel.
