Mr Agius commenced proceedings with an apology for his side's unintended failure to forward certain paperwork. The Commissioner accepted the gracious apology.
The cross examination of Mr Chiavaroli continues.
Mr Chiavaroli was quizzed about his contractual relationship with workers who are engaged as independent sub-contractors with ABNs. He was asked about his knowledge of the ATO rules - he states that he engaged with workers on the Pentridge site in a manner consistent with the guidelines set out by the Master Builders' Association.
Mr Agius is now running through a list of propositions that are at odds with the contents of Mr Chiavaroli's statement or other evidence. Mr Chiavaroli is batting each of them away with a reinforcement of his evidence as truthful and complete. Where Mr Agius has put further and better particulars of any event which have become available since Mr Chiavaroli made his statement he has agreed with Mr Agius's proposition. He appears as a witness of truth.
At 2.35PM Mr Agius completed his cross examination. Mr Stoljar tendered 3 further documents in his re-examination of Mr Chiavaroli.
AT 2.40PM Mr Chiavaroli was excused.
