John Setka’s PM defamation case appeal bid rejected

 

 

The High Court has rejected a bid by union secretary John Setka to appeal against Tony Abbott’s use of a truth defence in a high-stakes defamation case.

The Victorian Construction, Forestry, Mining and Energy Union secretary has alleged a speech made by Mr Abbott and broadcast by Sky News in February 2012, when Mr Abbott was Opposition Leader, portrayed him as an industrial thug and gravely injured his credit and reputation.

Mr Setka has taken particular offence to Mr Abbott’s reference to “home visits” by union-associated figures, saying it implies he goes to the houses of construction executives to intimidate and effectively extort them.

The Prime Minister is fighting the claim with a truth defence, pointing out accusations of threats and intimidation against Mr Setka going back more than two decades as well as convictions for contempt of court.

The Victorian Court of Appeal last year rejected Mr Setka’s attempt to strike out the defence, saying previous decisions which established the defence were correct.
