Day 2 of CFMEU organised crime hearing at TURC commences at 10AM - Mr Parker in the witness box

Mr Parker and the Commission have heard this intercepted telephone call between Mrs Kerryn McWhinney who works at the CFMEU and Mr Parker - they discuss the phoenix/bankrupt companies at the time that Mr Parker was negotiating an EBA with just that company.

IN this second intercepted call, Brian Parker discusses arrangements with Mace Hirani, associated with the George Alex companies.   Parker wants to get his story straight with a dossier of documents to satisfy the media and the CFMEU BCOM that George Alex was not associated with the Capital companies when in fact Parker knew he was.

 

Mario Barios and Brian Parker discuss George Alex's contact with Mr Barios which Barios interpreted as a threat.   Barios discusses going to the police to report the threat - Parker vouches for Alex's character, he 'never ever ever" threatens people, date 20 August 2014.

 

Parker callled Rita Mallia straight after that call, 20 August 2014.

 

The next morning Parker discusses the matter with CFMEU delegate Kera

 

 

Here's Mr Parker discussing a get together with Mace Hirani at the mysterious Kent Street premises on 21 August 2014.  This was taking place at the same time that the text messages between Hirani and Alex were being exchanged (referred to yesterday at the Commission).

 

On 22 August 2014 Brian Parker and Tom Mitchell discuss Darren Greenfield (the big fella) who was giving evidence that day in a private hearing at the TURC.

Brian Parker claims not to know whether or not he was discussing the George Alex companies with Tom Mitchell.

Mr Parker just made a very important slip-up and Ms McNaughton picked up on it immediately, he let slip that Tom Mitchell was working for one of George Alex's companies.   He now states that he does't know who Mr Mitchell was working for.

The Commission heard this intercepted telephone call between Mr Parker and Ms Mallia (CFMEU NSW President) on 27 August 2014.   They discuss Mario Barios (a BCOM member) and George Alex companies.

 

Mr Parker discussed his hot temper at length, he said to Ms McNaughton, "Are you trying to get me in a heat of rage now?"

Ms McNaughton asked the Commissioner if that would be an appropriate time to break for morning tea - the Commissioner felt it would indeed.

THE COMMISSION IS ADJOURNED UNTIL 11.45

AT 11.45 THE COMMISSION'S HEARING RESUMED

The Commission heard this intercepted telephone call between Darren Greenfield and George Alex, recorded at 3.45PM on 29 August 2014 - Tom Mitchell is apparently on the phone with one of the parties and Brian Parker agrees that he is the Brian referred to in the conversation.

Ms McNaughton tendered the transcripts of 12 further telephone intercepts into evidence - Mr Parker objected to the tender of 2 calls, one between him and his wife.

AT 1220 MS MCNAUGHTON COMPLETED HER EXAMINATION

Mr Agius for the CFMEU has no questions for Mr Parker.

AT 1230 THE COMMISSION ADJOURNED TO ALLOW COUNSEL FOR MR PARKER TO OBTAIN INSTRUCTIONS FROM HIM - TO RESUME AT 1245 OR EARLIER

At 1234 the Commission resumed.   Mr Game for Mr Parker asked a few questions about the circumstances of Mr Parker engaging separate legal counsel from the CFMEU.

Mr Parker said that Dave Noonan told him that he would have to get a different lawyer.

Mr Parker said that he felt he had no choice to get separate legal counsel.   

Ms McNaughton is now re-examining Mr Parker - she pointed out that earlier in his evidence he stated that "it was my choice" to engage separate lawyers.

Ms McNaughton read from the transcript - Mr Parker told Mr Morrison that the decision to "get a special lawyer just for him and the rest of the team have to share" was his.

Ms McNaughton asked Mr Parker whether or not he considered himself an intelligent man.  Parker stated that he is a "mirror twin" and he is the polar opposite of his top of the class brother.

Ms McNaughton has completed her examination.

After the Commissioner's intervention Ms McNaughton resumed questioning Mr Parker - she put it to him that he was not telling the truth when he said it was his decision to engage separate legal counsel.

Parker jumped in unsolicited with "I'm not avoiding the question, I'm not trying to be tricky - I'm being honest".

The Commissioner intervened - and said, "just pause before you answer this question Mr Parker - did you have a conference with Mr Game a few days after you spoke with Mr Noonan?"

Parker didn't pause, he said, "I think it was a long time later on that I went in to Tim's chambers, I can't recall, I'd have to look at my diary."

The Commissioner read from Mr Game's letter in which Mr Game of Counsel referred to a meeting with Mr Parker on the day before, i.e. 12 November 2014.

Mr Parker has been excused.

AT 1255 THE COMMISSION ADJOURNED UNTIL 2PM
