The TURC's afternoon session, 19 June 2015 is now in session - witness is Darren Greenfield

At 2PM the Commission recommenced its hearing.

Ms McNaughton tendered a letter from Slater and Gordon regarding the circumstances of Mr Parker engaging separate legal counsel.

The Commissioner made orders regarding the receipt of any materials that any party may wish to make in relation to the matter of Mr Parker's evidence on the issue of his legal counsel.

For the avoidance of doubt - the Commissioner made clear that Mr PARKER has not been excused on the summons which brought him before the Commission.

Mr Darren Greefield has been sworn and is in the witness box.

Mr Greenfield agreed with Ms McNaughton SC that he has appeared twice before the Commission and has made several statements to the Commission.

Mr Greenfield states that he was a delegate for a scaffold company and Andrew Ferguson asked him to join the Branch Committee of Management of the CFMEU NSW Branch.   He believes he was asked to join the BCOM in 2005.
 

Mr Greenfield states that he is a friend of Brian Parker.   He has been friendly for at least a decade.

Ms McNaughton asked, "have you ever received money from George Alex, from a pre-arranged location, or from persons known to be associated with George Alex?"

Mr Greenfield, "No."

Ms McNaughton told the Commission and Mr Greenfield that she would produce a series of text messages which were retrieved when police executed a search warrant on George Alex's phone on 4 September 2014.

She states that the first text messages appear to be filed in Mr Alex's phone under the name "Eddie H Stiletto".   Mr Greenfield states that he has no idea who that is.

Dec 5, 2012 - State and federal police are currently raiding the inner-city brothel Stiletto, owned by gambling identity Eddie Hayson.
 
 
 Mr Greenfield states that a series of texts on Good Friday were to do with scaffolders not getting paid.
 
Ms McNaughton has a very large series of text messages - she's putting them all to Mr Greenfield who has an answer for each of them along the lines of "I only ever contacted Mr Alex for legitimate union related purposes such as collecting overdue payments owing to CFMEU members".
 
Ms McNaughton, "Was it a bit special to go to Mr Alex's place on a Friday evening?"
 
Greenfield, "no".
 
Ms McNaughton read out a text message from Greenfield to Alex - "is it possible to pick up that paperwork this arvo instead of Friday, I'm going away tomorrow"
 
George Alex texted back, "Yes buddy, just making arrangements now".
 
Mr Greenfield denies that he was collecting $2,500 in cash from Mr Alex.
 
Mr Greenfield was shown a series of texts between "Nectar" who Mr Greenfield agrees is Nectari Alex, George Alex's wife and Mr Alex.
 
Alex texts Nectari giving directions as to how much money to give to various persons, including "2,500 to Darren".   Ms McNaughton reminded Mr Greenfield that he is under oath.   She was exquisitely precise in describing the location from which it will no doubt be alleged Mr Greenfield retrieved money at the Alex apartment.
 
There's no doubt police had a LD and video recorder in the Alex apartment - Mr Greenfield should tread warily.
 
Darren Greenfield was formally interviewed by the CFMEU President Rita Mallia after the Fitzpatrick death threats.   The first text message Greenfield sent at the conclusion of the meeting was to George Alex.
 
It's now 3.15PM and for at least one hour Ms McNaughton has been reading out text messages of a surprisingly familiar nature between Mr Alex and Mr Greenfield.
 
One text message from George Alex to Mace Hourari "put $5K in  toilet".
 
Mr Greenfield now claims that he would go to the Alex toilet to collect documents from the drawer  - a text from Alex to Greenfield says, "toilet, first drawer".
 
Another text from George Alex to a 3rd man says, "put $2500 in drawer under sink".
 
Somehow Mr Greenfield kept a straight face when he answered that he would arrange to pick up business papers from Mr Alex's home - in the drawer under the sink in the toilet.
 
Ms McNaughton, "Is it your honest answer that you have never seen cash in the toilet, is it your honest answer that documents were left for you in the toilet drawer?"
 
Greenfield says, "Yes, it's a serious answer."
