Mr Stoljar has put Mr Shorten's work history to him, joined the AWU in 1994, became state secretary Victoria 1998, National Secretary 2002 and joined the Parliament in 2007.
Mr Shorten agreed with the history.
Mr Shorten is examining a document concerning a company called UniBuild - 19 February 2007.
Shorten was asked whether he recalled the document - a Mr Wilson worked as Shorten's campaign director for his federal parliamentary seat.
The letter is addressed to Mr Lance Wilson from UniBuild - 19 February 2007, the date for the federal election hadn't been announced.
UniBuild is a labour hire company. Ted Lockyer was the boss, he and Shorten knew each other well.
Stoljar, "Were you involved in the arrangement contemplated in this document, were you aware that Mr Lance Wilson would be employed by UniBuild but would work on your campaign full time?"
Shorten, "yes".
Shorten is being quizzed about this agreement:

Shorten tried to say that he wasn't the Secretary of the Victoria Branch of the union - that's not really relevant, this is a national agreement.

Shorten says Michael Chen "could well have" prepared a contract - in fact he did. Here is Shorten's maiden parliamentary speech:
Shorten says he may well have asked someone to draw up a contract between the union and Unibuilt to "regularise" the arrangement - involving the employment of someone from Unibuilt to work on Shorten's federal election campaign.
Stoljar, "There's nothing regular about this arrangement is there?"
Mr Shorten was asked who else worked on his campaign. He states that he doesn't want to name the person publicly, he asked for permission to write it down. Shorten writes the name down - Mr Stoljar tells the Commissioner he sees no need to keep the name confidential.
Mr Stoljar, "I'll refer to this person as 'the mystery person'".
Shorten said he'd prefer that the person be referred to as the second campaign worker.
Shorten states that the Australian Workers Union national office paid for the second campaign worker.
Shorten states that he'd use employees from the AWU for letter box drops.
Shorten was shown an email from Michael Chen to Ted Lockyer - 19 February 2007, "Hi Ted, Bill asked me to email you this letter...."
Stoljar, "Does that refresh your memory, that you did ask Michael Chen to send the draft letter of offer to Ted Lockyer"
Shorten prevaricated. He was asked the question a second time. He agreed that he did ask Chen to send the letter.
The job offer is for a position as "research officer" with Unibuilt. The purported contract falsely states that Lance Wilson is a research officer with Unibuilt when in fact he was Shorten's campaign director.
Shorten agrees that it is false to say that Wilson was a research officer.
Stoljar, "Did Unibuilt ask for any favours in return?"
Shorten, "No."
Stoljar, "What's the head of the union doing using his position as National Secretary of the AWU using his position to obtain an advantage for himself, namely getting the services of a campaign director to get himself elected to parliament'.
Shorten vigorously disagreed.
On 16 May 2007 Unibuilt sent a letter to Cesar Melhem - it contemplates a change in the arrangements, such that Mr Wilson would become an employee of the union contracted to Unibuilt, the AWU would start issuing invoices to Unibuilt.
Stoljar, "Was that your understanding of the arrangement?"
Shorten, "I didn't see this letter until the Royal Commission kindly provided it to me, I understood that Unibuilt would be paying for Mr Wilson."

There is no mention of Unibuilt
It doesn't cause Shorten any concern that a company that was negotiating an EBA with the AWU was at the same time providing a paid campaign manager for that union's national secretary to obtain for that secretary a position in the federal parliament.
